The Contest is for residents of Canada only, excluding Quebec, and shall be construed and evaluated according to the laws of Canada. Do not proceed in this Contest if you are not a legal resident of Canada. Further eligibility restrictions are contained in the official rules below.

1. CONTEST PERIOD

Entries for the Do It Like a Local in Toronto photo contest, sponsored by Staying Native, will be accepted from August 5th, 2014 at 9:00 a.m. Eastern Time (“ET”) to August 31, 2014 at 5:00 p.m. ET. (“Contest Period”).

2. ELIGIBILITY

The Contest is open to legal residents of Canada, excluding Quebec, who are 18 years of age or older. Void where prohibited by law. Entries must be from individuals only; groups, organizations, studios, professional photographers (defined as someone earning the majority (51% or more) of their annual income from photography), and multiple-party entries are not eligible.

To participate in this Contest, each entrant must:

  • Provide the location of the photo in the space provided.
  • Tell us about your photo in the space provided.
  • Provide contact information
  • Upload your photo.

3. ENTRY

Eligible entrants are asked to submit an image (defined as one (1) single photograph) to our user gallery online at http://staying-native.com/en/destination/toronto/photo-contest/do-it-like-a-local-in-toronto:submit. Each person can enter up to 3 (three) images, but must use the same name and contact details and must be submitted within the Contest Period in order to be eligible for a prize. Each Image entered must consist of one (1) single photograph taken within Toronto that meets the criteria as outlined on the “Do It Like a Local in Toronto” Contest page and the judge’s criteria as outlined in these rules in paragraph 5.

The Image must be saved as JPEG or PNG format, at least 1050 pixels wide by 700 pixels high, file size must be 2MB or less. The Image must be the entrant’s own original work. The content of the image must not be altered. Only minor retouching which conforms to currently accepted standards in the industry is allowed. The judges are the ultimate arbiter of these standards and may at their discretion request the original, un-retouched file as recorded by the camera.

Incomplete entries will not be eligible to win. Entrants must have all ownership rights in and to the Entry, and the Entry must not infringe the rights of any third party and must be suitable for publication and use. Staying Native reserves the right to disqualify, without notice, any Entry if found in Staying Native’s sole discretion to be incomplete, fraudulent, infringing upon existing rights of others, inappropriate, libelous, plagiarized, obscene, vulgar, offensive or otherwise unsuitable in any way for print or publication.

Odds of winning depend on total number of eligible entries received. One prize per household.

4. PRIZES:

Three grand (3) prizes will be awarded. Each Prize Winner will receive one (1) of the following Toronto Experience Prize packages; Downtown Experience, Visit Niagara and North of the City. Prizes will be awarded within thirty (30) days of the announcement of the winners. Winners are subject to eligibility verification and compliance with these Official Rules. Prizes must be accepted as awarded and are neither transferable nor redeemable for cash. Any additional costs incurred in collecting and using a Prize are the winner’s responsibility. Staying Native reserves the right to modify the prize package in the event of unavailability of any item listed.

5. GRAND PRIZE WINNER SELECTION:

A judging panel comprised of Staying Native executives and a professional photographer will choose the 3 (three) Grand Prize Winners from all the photographic images entered into the contest within the contest period. Grand Prize winners will be notified by e-mail on or before September 30, 2014.

6. RIGHT TO USE SUBMISSION AND INFORMATION

By submitting an Entry, entrant, grants to Staying Native, (1) an irrevocable, nonexclusive, perpetual, worldwide, royalty-free right and license to use, display, modify, reproduce, publish, distribute, make derivative works of, sublicense, and otherwise commercially and non-commercially exploit the Images, and all intellectual property rights therein, in any manner or medium now existing or hereafter developed (including but not limited to print, film, or electronic storage devices), without compensation of any kind to entrant or any third party and (2) the right, except where prohibited by law, to use entrant’s name, likeness, picture, address (city and province), e-mail address, voice, biographical information and written or oral statements, for advertising and promotional purposes in promoting or publicizing Staying Native and its products or services, without compensation unless required by law.

Entrant shall have no right of approval, no claim to compensation, and no claim (including, without limitation, claims based on invasion of privacy, defamation, or right of publicity) arising out of any use, blurring, alteration, or use in composite form of entrant’s name, picture, likeness, address (city and province), email address, biographical information, or Entry. The rights granted under this paragraph shall extend to Staying Native and its affiliated companies with respect to all entrants in the Contest, including non-winners and winners. Staying Native respects the copyright ownership rights of photographers, and should Staying Native wish in the future to use an Image for a purpose other than in connection with promotion of this site or future contests, Staying Native will contact the owner to purchase the rights for this use for a reasonable fee.

7. GENERAL

The Contest Winner will be required to answer a skill testing question and complete and return a standard Declaration and Release Form within seven (7) days of receipt before the Prize can be officially awarded. Should a winner be deemed ineligible or fail to return the required form within the time period allowed, an alternate winner may or may not be selected. Staying Native reserves the right, in its sole discretion, to modify, suspend or terminate the Contest should the administration or security of the Contest become compromised. The Contest Sponsor assumes no responsibility for: entries lost, stolen, delayed, damaged or misdirected, or for the failure, interruption, technical malfunction or delay of any email or other communication to be received, for any reason; any incorrect or inaccurate information, whether caused by contest website users or by an equipment or programming associated with or utilized in the contest by any technical or human error which may occur in the processing of entries in the contest; problems with the function of any website or website feature howsoever caused; the malfunction of, or damage caused to, any telephone network or lines, computer equipment, data or software, online systems, servers or access providers; any functionality lost due to not having cookies enabled; traffic congestion on the Internet; the security or privacy of information transmitted via computer networks; or for breaches of privacy due to interference by third party computer “hackers”. By entering, entrant, (a) agrees to be bound by the Official Rules and the decisions of Staying Native (including but not limited to eligibility determinations) which are final and binding in all respects; (b) agrees to release Staying Native and its employees and agents from any and all liability, loss, damage or injury resulting from participation in this Contest or awarding, receipt, possession use and/or misuse of any prize awarded herein and acknowledge that Staying Native and its employees and agents have neither made nor are in any manner responsible or liable for any warranty, representation, or guarantee, expressed or implied, in fact or in law, relative to any prize; and (c) consents to use of entrant’s name, Contest Entry and/or likeness for advertising and promotional purposes in connection with this Contest without additional compensation, unless prohibited by law.

By entering this Contest, each entrant expressly consents to the Sponsor, its agents and/or representatives, storing, sharing and using the personal information submitted with his/her Entry only for the purpose of administering the Contest.
